The court granted a temporary stay of a lower court ruling that blocked the law.
The Fifth Circuit U.S. Court of Appeals granted a temporary stay removing the block by Judge David Alan Ezra of a Texas immigration law that would allow state law enforcement to arrest and detain those suspected of entering the U.S. illegally.
Judge Ezra had ruled for the District Court of West Texas, “If allowed to proceed, SB 4 could open the door to each state passing its own version of immigration laws.”
The appellate court has put its ruling on hold for one week to provide President Biden’s administration time to appeal to the Supreme Court.
Texas maintains that the law does not conflict with federal law but allows the state “to defend itself from an invasion.”
